Welcome to Blaze Roadside & Transport Inc. By using our website and services, you agree to be bound by these Terms of Service. Please read them carefully.
1. Services
Blaze Roadside & Transport Inc provides towing and roadside assistance services in Northeast Georgia. Our services include but are not limited to: towing, jump starts, tire changes, lockout assistance, and winch-out recovery.
2. Service Requests
When you request our services, you agree to provide accurate information including your location, vehicle details, and contact information. Providing false or misleading information may result in service delays or cancellation.
3. Pricing and Payment
- Quotes provided are estimates and may vary based on actual conditions
- Final pricing will be confirmed before service begins
- Payment is due upon arrival before service begins unless otherwise arranged in advance
- Service will not commence until payment is received
- We accept major credit cards, debit cards, cash, Venmo, and Zelle
- Additional fees may apply for after-hours service, extended distance, or special circumstances
4. Cancellation Policy
- You may cancel a service request free of charge within 15 minutes of the driver being dispatched
- Cancellations made after 15 minutes of dispatch, or after the driver has begun traveling to your location, may be subject to a cancellation fee
- Once our driver has arrived at your location, a cancellation fee will apply
- Cancellation fees help cover driver time, fuel, and opportunity costs
- We reserve the right to waive or adjust cancellation fees at our discretion
5. Vehicle Condition & Pre-Existing Damage
By requesting our services, you acknowledge and agree to the following:
- You are the legal owner or authorized representative of the vehicle
- You have removed all valuables from the vehicle before service
- You are responsible for disclosing ALL known pre-existing damage, mechanical issues, fluid leaks, non-functional components, or any other vehicle conditions prior to service
- We are NOT responsible for any pre-existing damage, mechanical issues, or conditions that existed before our service began, whether visible or not
- Pre-existing conditions include but are not limited to: engine or transmission problems, electrical issues, suspension damage, body damage, tire condition, wheel bearings, hub assemblies, CV joints, axles, brake issues, fluid leaks, and any mechanical failures
- Vehicles are often towed because they are already damaged or non-operational; we are not liable for the underlying condition that necessitated the tow
6. Documentation & Recording Practices
To protect both parties and ensure accurate records, you acknowledge and consent to the following:
- Photo & Video Documentation: Our drivers photograph and/or video record vehicles before loading, during transport, and after delivery. These records document the vehicle's condition at each stage of service.
- Call Recording: All phone calls to and from Blaze Roadside & Transport Inc may be recorded for quality assurance, training, and documentation purposes. By calling us or accepting our calls, you consent to recording.
- GPS & Service Records: We maintain detailed records of service times, locations, and driver activities.
- Record Retention: Documentation is retained for a minimum of two (2) years and may be used as evidence in any dispute or legal proceeding.
7. Damage Claims & Dispute Resolution
If you believe damage occurred during our service:
- Immediate Notification: You must notify our driver of any concerns BEFORE the driver leaves the delivery location. Once the driver departs without notification of an issue, the vehicle is deemed delivered in satisfactory condition.
- Unattended Pickup/Drop-off: If you choose not to be present at the pickup or drop-off location (e.g., leaving keys for pickup or requesting delivery to an unattended location), you waive your right to an in-person inspection. Our photo and video documentation at the time of pickup and delivery will serve as the official record of vehicle condition. By requesting unattended service, you accept the vehicle condition as documented and acknowledge you cannot later dispute condition based on your absence.
- Customer Presence Recommended: We strongly recommend that you or an authorized representative be present at both pickup and drop-off to inspect the vehicle and sign off on its condition.
- Written Claim Required: All damage claims must be submitted in writing within 24 hours of service completion, including detailed description and photographs of the alleged damage.
- Investigation: We will review our photographic/video evidence, call recordings, and service records to evaluate any claim.
- Fraudulent Claims: Filing false or fraudulent damage claims is a violation of these terms and may result in legal action. We reserve the right to report suspected insurance fraud to appropriate authorities.
- Burden of Proof: The claimant bears the burden of proving that damage occurred during our service and was not pre-existing.
8. Limitation of Liability
To the fullest extent permitted by law, Blaze Roadside & Transport Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific service in question.
9. Insurance
We maintain appropriate insurance coverage for our towing operations. However, we recommend that you maintain your own vehicle insurance for comprehensive protection. Our insurance covers damage caused by our negligence during service; it does not cover pre-existing conditions, mechanical failures, or issues unrelated to our handling of your vehicle.
10. Website Use
By using our website, you agree to:
- Use the website only for lawful purposes
- Not attempt to interfere with the website's functionality
- Not submit false or spam information through our forms
- Not copy or reproduce website content without permission
11. SMS Communications
If you opt in to receive SMS messages, you consent to receive service-related text messages including quotes, ETAs, and payment notifications. Message and data rates may apply. You can opt out at any time by replying STOP. See our Privacy Policy for more details.
12. Indemnification
You agree to indemnify and hold harmless Blaze Roadside & Transport Inc, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms, including any costs or attorney fees incurred in defending against fraudulent or frivolous claims.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia. Any disputes shall be resolved in the courts of Barrow County, Georgia.
14. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.
